Who Should Own My Life Insurance Policy?
- 0 POINTSContact Meview profileDavid RacichPROFountain Hills, ArizonaLife insurance is personal property. The ownership of personal property has an inherent tax potential for earnings above basis and the death proceeds in corporate business and estate scenarios. In community property states, policy ownership takes on additional considerations. In a domestic planning scenarios, some advisers recommend cross ownership between married couples. In estate planning, they recommend that an irrevocable life insurance trust own the policy. In Business scenarios, some recommend holding the policies in separate entities or secular or rabbi trusts. Once the tax exposure of ownership has been analyzed you can determine the ownership issue.Answered on June 8, 2013+01 0+1 this answerflag this answerview more answers by David Racich

The owner has the right to borrow, cancel and change the beneficiary. Under certain conditions it makes sense for someone else to be the owner of the policy including (1) policies on dependent children should be owned by their parents (2) policies purchased by a corproation to cover one of their employees under key man insurance (3) policies on grown children who are not mentally capable of making financial decisions. Typically the owner is the person who is financially responsible for the premium payments and would face financial challenges in the event of the insured's death.Answered on June 9, 2013flag this answer
