All you will need is a competent lawyer, a good reason to sue, and a solid winnable case. If you have all of those things, then you can bring suit against your insurance company. Good luck. Courts, generally, favor that procedure; however, if the cause of action is sufficiently serious the case might well be heard in court. Insurance companies do not like to litigate.
