    Yes, if you feel that your auto insurer has either caused you some loss for which they are liable or if you feel that they are not honoring the stipulations of the contract that they have with you you can certainly file a lawsuit against your insurer.

    Traditionally, lawsuits filed against insurers are equity suits and are filed pursued to enforce a provision of a contract.

    Yes, if they have violated the contract that you and they agreed to. Trust me on this one. It is soooo much better first to to to your agent and see if he has a common sense answer. If they do not, some do not they cannot even get out of the rain because they think flood is covered under the homeowners policy). Most agents would rather tell their spouse know and feel the pain than to tell a cash paying customer their screwed. Next, you cannot imagine how much heat you can bring down by calling and then writing a letter to the department of insurance fulling explaining in exact detail what is going on.....also, adjusters have recorders and so should you with all conversations even on the phone
