Annuities already avoid probate. There are only two reasons I would ever put an annuity into a trust is 1. if the trust is Irrevocable and the owner has an estate tax problem. Annuities offer a stable safe growth product that could be placed in trust if desired. Does an annuity have to be put in a trust? No, not really. An annuity offers certain tax and death benefits on it's own that would work effectively without being in trust anyway.
