If the Company is paying its employees to drive the vehicles, the company must have a Commercial Auto Policy. The commercial auto policy also must include non-owned vehicle coverage when your employees are driving the car. The customer cannot sign an agreement to only sue the driver because the insurance company the customer has is required to act on behalf of the customer regarding subrogation. The company's insurance will be responsible for any damage or theft while the vehicle is in the company employee's possesion.
