All policies are not created equally, but I am both an agent and a purchaser of my own personal insurance and have had my own issues with a couple of carriers. My suggestion to you is that before you hire a lawyer to file a civil action you avail yourself of services that don't cost you anything. If you have not been treated well an Insurance Department may offer a better way of approaching the issue than an attorney. Typically an attorney for a plaintiff will charge as much as 30 to 40 % of a settlement and they will be unlikely to pursue the small stuff. Insurance departments in the 50 state have jurisdiction over the company's actions and filing.
